1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Ndani Media Group ("we," "us" or "our"), concerning your access to and use of the ndanimedia.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

2. Intellectual Property Rights

Unless otherwise indicated, the Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Ndani Media Group, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

3. User Representations

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms and Conditions.

4. Voting and Payments

Voting: Ndani Media may host awards and competitions that allow public voting. We reserve the right to disqualify votes that we determine, in our sole discretion, to be fraudulent, automated, or in violation of the spirit of the competition.

Payments: Voting packages and other services may require payment via M-Pesa or other payment gateways. All payments are final and non-refundable unless otherwise stated. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

5. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include, but are not limited to:

• Systematically retrieving data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Using any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
• Attempting to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

7. Governing Law

These Terms shall be governed by and defined following the laws of Kenya. Ndani Media Group and yourself irrevocably consent that the courts of Kenya shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

8. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms and Conditions.
